Terms & Conditions

1. Bookings:

A £200 deposit is required to secure your booking. By booking you accept our Ts & Cs. The deposit is deducted from the balance of your MPR package cost. Your deposit can only be refunded if you cancel prior to 8 weeks before the start date of the retreat. Payment must be made in full prior to 4 weeks before the start date of the retreat. You may ask for a payment plan, in which 4 payments are made separately in the months leading up to the event, this must be agreed in advance. If you cancel your booking after 8 weeks before the start of the retreat your funds are non-refundable, as we require Retreaters to commit to the dates. See Cancellations for more details.

The fees are stated on the website (see Accommodation).

2. Registration:

Guests must arrive between 6-8pm on the first evening of the residential retreats, snacks & refreshments will be available, this is a chance to say hi to your fellow Retreaters & get a good nights sleep before the first session on the Monday.

3. Travel:

3.1 Car parking facilities are provided for no extra fee.

3.2 Disabled parking spaces are available.

3.3 Guests are responsible for travel to & from MPR themselves: the full address is Denmark house, 116 Common Road, Blue Bell Hill, Chatham, Kent , ME5 9RG.

       

4. Cancellations:

Cancellations will only be accepted up to 8 weeks before the event takes place. If you cancel prior to 8 weeks before the start date your deposit & any fees paid will be refunded. Retreaters are required to commit to the dates, therefore if your place is cancelled after 8 weeks before start date we will retain your deposit & fees unless the reason is a force majeure. For a force majeure to be accepted the reason for cancellation must be unforeseeable events, external to the contracted parties & serious enough to render it impossible for the party to attend.

5. Changes to the program:

We reserve the right to make changes to the advertised program & producers. Due to the nature of the music industry, changes will sometimes occur, as occasionally the original producers may be unavailable. We always endeavour to replace producers with someone of similar experience & to give you as much notice as possible.

6. Cancellation of event & COVID strategy:

6.1 If we need to cancel the event you will be notified by email & you will receive a full refund. Our COVID policy allows us to cancel the event if there is a risk of health to participants & a full refund will be given.

6.2 We cannot reimburse travel costs or other losses incurred by you in the event of cancellation by you or us. You are strongly advised to take out travel insurance to cover potential loss arising from cancellation or other eventuality affecting your booking, including event fees & travel costs. You should check that any policy you take meets your needs.

6.3 Refunds will not be given to guests who arrive to the event with COVID or who test positive for COVID during an MPR retreat.

7. Conduct:

MPR’s collaborative events rely on a level of tolerance & respect from all guests for each other’s personal space & creative work. Each guest will be responsible for their own actions & to ensure they behave in a respectful way to all other people whilst at the MPR. We reserve the right to refuse a place & to exclude from a retreat any participant who, in our opinion, behaves in an abusive or disruptive manner or engages in any discriminatory conduct. No refund will be given if exclusion is made for these reasons. Our decision is final.

8. Under 18s:

Applicants must be over the age of 18 by the first date of stay.

9. Limitation of Liability:

9.1 To the fullest extent permissible by law, our liability for any loss or damage suffered by you shall be limited to that which arises out of the negligence of our employees, subcontractors or agents.

9.2 Notwithstanding sub-Clause 9.1 above, we shall not be liable for any indirect loss or damage which may be suffered by you including, but not limited to, loss of income, loss of business, loss of profits, loss of opportunity, loss of anticipated savings, loss of data or loss of enjoyment.

9.3 Nothing in these Terms and Conditions purports to limit or exclude our liability for:

9.3.1 death or personal injury caused by our negligence, our employees, subcontractors or agents;

9.3.2 fraud or fraudulent misrepresentation; or

9.3.3 any other matter for which it would be illegal for us to limit or exclude its liability.

11. Participation and access:

11.1 We are committed to providing a supportive & welcoming environment to all. During our 5 night retreat, participants should expect to take part in daily writing/recording/mixing/production groups & evening meal discussions. The MPR team provides some general support to all participants but not continuous care & participants should be able to live independently.

11.2 In the event that guests co-write a composition together the resultant IP in the composition & therefore the copyright splits shall reflect the co-writers contributions.

11.3 MPR management will decide on the daily teams & allocate writing/production groups. Due to the nature of the process we cannot guarantee every guest will participate in writing/mixing/production etc with every Producer or every other guest.

12. Data Protection:

We will not share your personal data with any third parties for any reasons without your prior consent. Such data will only be collected, processed & held in accordance with MPR’s rights & obligations arising under the provisions & principles of the Data Protection Act 1998.

13. Digital Assets, Ownership & Permissions:

13.1 Master Sessions are the property of MPR.

13.2 Contributing artists will have access to their parts of Master Sessions without fee or fine.

13.3 All digital content captured & recorded at MPR events may be used for MPR’s promotional & marketing purposes.

13.4 This is a recording studio retreat experience & the recordings that emerge during your stay are for personal use. If Retreaters wish to release them, they can do so without referring to the MPR team online or in their promotion. There has to be a clear distinction between Jim, Chris & Barny’s official production/composition/mixing work & their work as MPR workshop facilitators. Any questions about this can be made to the team in writing please.

14. No Waiver:

No failure by us to enforce any provision in these Terms & Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Terms & Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach & shall not constitute a continuing waiver.

15. Severance:

If any provision of these Terms & Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms & Conditions & the remainder of the provision in question shall not be affected.

16. Law & Jurisdiction:

16.1 These Terms & Conditions (including any non-contractual matters & obligations arising therefrom or associated therewith) shall be governed by & construed in accordance with the laws of England & Wales.

16.2 Any dispute, controversy, proceedings or claim between the Parties relating to these Terms & Conditions (including any non-contractual matters & obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England & Wales.
